Welcome to Diya Handicrafts. These Terms and Conditions govern your access to our online storefront, catalog, custom woodcraft commissions, and all related services operated from our artisan atelier in Vellar, Kovalam, Kerala. By registering an account, placing an order, or utilizing our services, you agree to be legally bound by these terms.

1. Introduction & Acceptance of Terms

These Terms of Service constitute a legally binding agreement between you ('Customer', 'Patron', 'You') and Diya Handicrafts Atelier & Woodcraft Showroom ('Diya Handicrafts', 'We', 'Us', 'Our'), located in Vellar, Kovalam, Kerala, India.

If you do not accept these terms in their entirety, you must discontinue using this platform. Completing user registration or ticking the acceptance checkbox constitutes execution of this contract.

2. Eligibility & Account Security

You must be at least 18 years of age and legally competent to enter into a contract under the Indian Contract Act, 1872.

You agree to provide true, accurate, and complete information during registration and keep your account credentials confidential.

You are solely responsible for all activities conducted under your authenticated account. Notify us immediately if you suspect unauthorized access.

3. Authentic Kerala Woodcraft & Natural Timber Nuances

Every idol, temple relief, and sculpture at Diya Handicrafts is individually carved by hand by master sculptors led by Shri Nagappan, adhering to traditional Shilpa Shastra proportions.

Natural Wood Characteristics

We work exclusively with authentic seasoned timbers: Solid Kerala Teak (Tectona grandis), Kumbil / Sacred White Wood (Gmelina arborea), and Heirloom Rosewood (Eetti).
Natural timber is an organic material. Variations in wood grain swirls, subtle tonal gradations, and natural grain knots are inherent to authentic living wood and are hallmarks of master handcrafting, not manufacturing flaws.
Because each sculpture is chiselled by hand without automated CNC mass stamping, dimensions and weight may have minor artisan tolerances of +/- 5%.

4. Bespoke & Monumental Custom Commissions

We specialize in bespoke monumental deities, sanctum panels, and custom-scale statues ranging from 3 inches to over 10 feet.

Commission Protocol

Custom orders require mutual agreement on dimensions, timber type, iconography posture, and finishing.
A milestone advance deposit (as agreed in quotation) is required before seasoned timber selection and chiselling commence.
Photographic updates of the clay/wood rough-out and detailing stages are shared with the patron via WhatsApp/Email.
Once a custom sculpture is completed and approved by the patron via photos/video, final payment is due prior to export crating and courier dispatch.

5. Pricing, Currencies & Payment Processing

Prices are displayed in Indian National Rupees (INR) and estimated US Dollars (USD). Domestic transactions are billed in INR and inclusive of applicable GST.

Online payments are processed securely through Razorpay. Supported payment modes include UPI (Google Pay, PhonePe, Paytm), Net Banking, RuPay, Visa, Mastercard, and International Credit/Debit Cards.

Diya Handicrafts reserves the right to correct pricing errors caused by technical misprints. In such rare instances, we will contact you for confirmation before processing.

6. Worldwide Shipping, Wooden Crating & Customs

We ship sculptures domestically across India and internationally to over 30 countries (USA, UK, Canada, Australia, Europe, GCC, and Southeast Asia).

Packaging & Delivery Standards

Each artwork is encased in multi-layer shockproof cushioning, moisture barriers, and custom-built reinforced wooden crates.
All export wood packaging receives certified phytosanitary treatment and heat fumigation in accordance with international ISPM-15 quarantine standards.
Dispatch timelines: In-stock sculptures dispatch within 2–4 business days. Custom commissions follow agreed artisan carving timelines.
International Customs & Tariffs: Any import customs duties, value-added taxes (VAT), or clearance handling fees levied by the destination country's customs authority are the legal responsibility of the consignee.

7. Transit Inspection, Damages & Returns Policy

We take extraordinary pride in packing our sacred woodcrafts to withstand global air and ocean transit. In the rare event of damage in transit:

Inspection & Claim Protocol

Patrons are advised to record an unboxing video when opening the outer wooden crate.
If external damage or sculpture breakage is discovered, notify our support team within 48 hours of delivery at contact@diyahandicrafts.online with clear photos and video.
Upon verification of transit damage, Diya Handicrafts will arrange artisan restoration, full replacement, or an insurance claim refund.
Due to the consecrated, sacred, and custom-made nature of master wood sculptures, returns due to general change-of-mind cannot be accepted once custom carvings have been dispatched.

8. Intellectual Property & Watermark Protection

All visual craft lineups, sculpture photography, catalog descriptions, brand iconography, and website software are the exclusive intellectual property of Diya Handicrafts and Master Sculptor Shri Nagappan.

All displayed product and gallery imagery includes digital copyright watermarking. Any unauthorized commercial copying, reproduction, AI model scraping, or trademark infringement will be prosecuted under the Copyright Act, 1957.

9. Disclaimer of Warranties & Limitation of Liability

Our digital platform is provided on an 'as-is' and 'as-available' basis. While we strive for 100% uptime and precision, we do not warrant uninterrupted access during server maintenance.

To the maximum extent permitted by law, Diya Handicrafts shall not be liable for indirect, incidental, or consequential damages resulting from platform downtime or courier delays caused by force majeure events (natural disasters, customs strikes, or extreme weather).

10. Governing Law & Jurisdiction

These Terms and Conditions and any transaction dispute shall be governed by, construed, and enforced in accordance with the laws of the Republic of India.

The courts of Thiruvananthapuram, Kerala, India shall have exclusive jurisdiction over any legal proceedings arising out of or related to these terms.
